NADIKS suggested the market to amnesty communication networks in multiroom houses for fight against discrimination of management companies on access to such buildings


The National Association of House Information and Communication Networks (NAHICN) suggested the market to amnesty communication networks in multiroom houses for fight against discrimination of management companies on access to such buildings.

The vice-president of NADIKS for legal questions Mikhail Pashkov reported about it on the round table passing within the XXVI International exhibition "Svyaz-Expokomm 2014".

According to him, on one of meetings of the working group of the Ministry of Telecom and Mass Communications, NADIKS submitted the concept of a way on which regulation has to develop to simplify access of communications operators to the general property of owners of an apartment house for consideration.

Amnesty means itself registration, entering into the state register and transfer to balance of operators of the communication networks constructed by them in apartment houses.

"We consider that that "About communication" is provided by the federal law, but the concept of registration of the property right to communication networks and segments of networks is not realized, the communications operator cannot differentiate the property right to the communication network from the general property of an apartment house, – Mikhail Pashkov explained. – It also creates those collisions which communications operators face daily".

He noted that the communications operators which constructed house networks consider that networks belong to them while provisions of the Civil code of the Russian Federation indicate the opposite – everything that is in walls of houses, belongs to his owners.

"Therefore as soon as we will enter institute of communication of registration of the property right of communication networks and their segments, and also we will declare amnesty of the communication networks constructed and put into operation in apartment houses, the problem will be solved according to the law, – Pashkov is sure. – This that means which will help operators to leave vicious practice of transfer of money to inadequate persons and participations in the doubtful relations with management companies".

Matter in that, the vice-president of NADIKS notes that management companies, as a rule, are not owners of rooms, where they render services in the contents and repair in those houses – respectively to raise a payment for access to house infrastructure they have no rights.

The press secretary of JSC Vympelcom Anna Aybasheva noted that the operator will study the offer of NADIKS, and emphasized that the subject of simplification of an entrance of operators to houses demands a number of changes in the legislation.

Earlier, the Association suggested to divide house networks on private and the general - the companies will be able to be connected to the last on equal terms and at reduced price.

According to the offer of NADIKS, in each multiroom house there has to be a communication network which is belonging to owners of the house, being a part of the general property and having the general introduction device. Existence of such general network is provided by the builder, and then – the management company (MC), the association of owners of housing (AOH), housing cooperative or the owners of rooms who chose a way of direct management.

The general network can be both is constructed, and transferred to one of operators on a paid or gratuitous basis. The burden of its contents, modernization and reconstruction is born by owners of rooms of an apartment house. Thus in parallel with the general network private networks on the basis of the current legislation can arise and function.

All communications operators get equal access to the general network on the basis of standard lease contracts with identical tariffs, unlike private where tariffs higher and can change depending on the user. The monthly maintenance of the general network provides UK or condominium, and also one of communications operators under the contract with them. Means which operators pay for rent of the general network, come or on the settlement account of condominium, or to fund of carrying out capital repairs of an apartment house, or to fund of universal service, or into other account established by the law.
